NOLA SMS Pro is a messaging platform that enables businesses to send SMS messages through integrated gateways and CRM systems, including automation, notifications, and marketing communications.

3. User Responsibilities

You Agree to:

- Provide accurate business and account information

- Use the Service only for lawful purposes

- Maintain the security of your account credentials

- Ensure that all recipients have given proper consent

You are fully responsible for all messages sent through your account.

4. Consent and Opt-In Requirements

You must obtain explicit consent from recipients before sending SMS messages, especially for marketing purposes, in compliance with applicable laws such as the Data Privacy Act of 2012.

You must also:

- Maintain proof of consent
- Clearly inform users they are subscribing to SMS communications
- Not send unsolicited or spam messages


You are fully responsible for all messages sent through your account.

5. Opt-Out and User Rights

All messages must include a clear way for recipients to opt out.

Example:
Reply STOP to unsubscribe


You must honor opt-out requests immediately and maintain suppression lists. SMS campaigns must support STOP or HELP keywords as standard practice

6. Sender ID Compliance

Users must comply with all Sender ID regulations:

- Sender ID must be registered before sending messages
- Unregistered Sender IDs may be blocked by telecom networks
-Sender ID must represent your brand and not mislead recipients
- Prohibited terms (e.g., “SMS”, “TEST”, telecom names) are not allowed

Failure to comply may result in message failure or account suspension.

7. Prohibited Content

You agree NOT to send messages that include:

- Spam or unsolicited promotions
- Fraudulent, misleading, or deceptive content
-Adult, illegal, or harmful material
- Gambling (unless properly licensed), drugs, or political messaging

- Content violating telecom or regulatory rules

8. Messaging Guidelines

You must:

- Identify your business clearly in every message

- Send messages only during appropriate hours

- Avoid excessive frequency or harassment

- Use approved and whitelisted URLs when required

9. Fees and Billing

- Sender ID fees, SMS costs, and subscription fees are non-refundable unless otherwise stated

- Pricing may change with prior notice

-You are responsible for all usage charges incurred under your account

10. Service Availability and Message Delivery

NOLA SMS Pro relies on third-party SMS gateways, telecom providers, and network operators for message delivery.

While we strive to provide reliable service, we do not guarantee successful or timely delivery of messages. Message delivery may be affected by factors beyond our control, including but not limited to:

- Network congestion or outages

- Telecom carrier filtering or blocking

- Unregistered or rejected Sender IDs

- Recipient device availability or settings

- Regulatory restrictions or compliance requirements

NOLA SMS Pro shall not be held liable for any message delivery failures, delays, or undelivered messages caused by these external factors.

11. Data Privacy

We respect your data and comply with applicable data privacy laws.

You agree to:

- Handle customer data responsibly

- Use the platform in compliance with privacy regulations

- Not misuse or resell personal data without consent

12. Account Suspension and Termination

We reserve the right to suspend or terminate your account if:

- You violate these Terms

- You send prohibited or spam content

- You fail to comply with legal or telecom requirements

No refunds will be issued for violations.

13. Limitation of Liability

NOLA SMS Pro shall not be liable for:

- Message delivery failures

- Loss of revenue or business

- Third-party service interruptions

- Compliance violations caused by user actions

14. Modifications

We may update these Terms at any time. Continued use of the Service means acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by the laws of the Republic of the Philippines.
